General Terms of Use and Conditions

 

The present General Terms of Use and Conditions apply to all orders made on the online boutique www.bureaudemode.com.   When a customer purchases a product from this website, he /she accepts the present General Terms of Use and Conditions in full.

We reserve the right to change the Terms of Use and Conditions at any time. In this case, applicable Terms of Use and Conditions are those published at the date of the order.

1.    Who Are We ?

The online boutique is managed by Von Engelswacht Bureau de Mode, société par action simplifiée.  All our contact details can be found here.

2.    Products

Products are offered for sale on the website by each fashion designer, in accordance with the concept of a consignment shop.

The boutique’s products are presented on the website with the necessary features, conforming to article L 111-1 of the French Consumer Code. This statute entitles the potential customer to read the essential features of the products he/she intends to purchase before effectively placing an order.

Offers on the website are valid within the limits of product availability.

Products on offer comply with applicable French law and norms. We shall not be held liable for the consequences of abnormal use by the customer.

 If the customer is domiciled outside of the French customs territory, it is his/her duty:

-        to pay the eventual tariffs and taxes;

-        to verify with local authorities the possibility to import or use the products or services he/she intends to order with local authorities.

We shall not be held liable in this regard.

3.    Order and Payment

The customer must follow the online process to place an order. All information he/she provides and the recorded signature shall serve as evidence his/her of purchase orders, signature, and acceptance of the recorded operations.

Prices are in euro. They apply at the date of purchase order by the customer. Delivery costs are added thereto and specified before the order is completed.

Prices are with all taxes included. They take the applicable VAT at the date of order into account. Any change in the applicable rate of VAT may be passed on in product prices.

Payment (price, VAT, shipment costs) must be made at the time of the order. Amounts paid shall never be regarded as a deposit or a downpayment.

To carry out his/her payment, the customer shall rely on the system proposed at the last step of order completion. This system is operated by Paypal and our bank Société Générale.

We reserve the right not to ship to, nor execute an order from, a customer who has not paid for all or part of a previous order, or with whom a payment dispute is pending.

4.    Shipping

Products are shipped to the address specified in the order. The customer must check that the data provided to us in the order, including the delivery address, is complete and correct. We shall not be held liable of any typing errors or consequences thereof. Costs incurred for the reshipping of an order will be supported by the customer.

Shipment costs cover wrapping costs plus effective postage costs. In some cases, for commercial purpose, a lesser amount is charged. In all cases, shipment costs are mentioned before the order is completed.

Cash on delivery is not accepted.

Orders are shipped either through La Poste, whose delivery time is normally 48 hours for France, or by special carrier, whose delivery times are determined on a case by case basis. Maximum time to carry out the order, conforming to the relevant French statute (loi n° 2008-3 du 3 janvier 2008 pour le développement de la concurrence au service des consommateurs) is thirty days.

Products are always shipped at the consumer’s risk from the moment we send them.  The consumer must check the correct state of shipment upon delivery.

In case of an anomaly (missing or deteriorated product; perforated, opened or deteriorated parcel), the consumer must imperatively refuse the shipment. He/she must mention his/her reason for refusal on the packing slip (“opened or damaged parcel refused”). Within 48 hours after delivery, the consumer must then file a motivated complaint with postal services or the carrier by recorded delivery letter with advice of delivery.

You must notify us with any anomaly pertaining to shipment on the same day as delivery or on the following day at the latest. We reserve a right to ask the consumer to send back the defective product. Whenever the aforementioned conditions are fulfilled, and provided the consumer’s request is legitimate, the defective product(s) is (are) either exchanged or reimbursed, or a missing product is shipped.

5.    Guarantees

The consumer benefits from all guarantees granted to him/her by law: guarantee against hidden defects, guarantee against non-conform or defective products.

In accordance with article L 121-20 of French Consumer Code, the consumer is granted with a withdrawal right of seven calendar days. In this time period, he/she may return at his/her own costs, the unsatisfactory product. The time limit starts from the day following delivery to the customer. Relevant products must be returned in their original wrapping, intact, unsoiled, without any trace of use, and accompanied with their instructions (when applicable). Initial shipment costs are borne by the consumer.

Comforming to the French Data Protection Act (loi n° 78-17 du 6 janvier 1978 sur l’informatique, les fichiers et les libertés), the consumer has a right to access and correct information relating to him/her. To exercise this right, he/she may contact us at: info@bureaudemode.com

6.    Applicable law and Competent Judge

Online purchases from the boutique are governed by French law. The purchase contract is established in the French language.

Any dispute or question on the interpretation of the purchase contract shall be litigated in the Tribunal de Commerce de Paris, France, even in the occurrence of a multiplicity of defendants or a guarantee call.

In case of conflict, The French version of the General Terms of Use and Conditions  shall be controlling.
